Can I refuse Volkswagen's emissions fix?

I have a 2012 Volkswagen Tiguan 2.0 TDI. I am waiting for the emissions software upgrade, what are the likely consequences of not upgrading my car? Will it effect the MoT and resale value? My car is running perfectly well at the moment and to have it 'degraded' by software does not seem sensible. It seems to me that if the software was 'right' for the car it would have been fitted as original equipment.
The EA189 software remap has caused problems for 13 readers owning Tiguan 2.0TDI 140s and I think Volkswagen has suspended it for the time being. Do not get it done until you can be reassured that it will not affect the running of the car.
