Oil cap not replaced after service - is the garage liable for engine damage?

My Mazda 6 had a service 9000 miles ago. Last week I opened the bonnet (to refill the washer bottle) and found that the filler cap was missing. Oil was everywhere and nothing is showing on the dipstick, although I’ve had no warning lights. I am now concerned the engine is damaged. What is my legal position with the dealer - who has offered to refill the sump as a 'goodwill gesture'.
Write a letter to the dealer and send it by post office special delivery so it becomes a matter of record informing him that you hold him responsible for any consequential damage as the result of the negligence of his employees in not refitting the oil cap.
