I have a 2007 Nissan Navara outlaw purchased as an ex demonstrator at 1 yr old with just under 8 k. It is financed HP with now Black Horse over 48 months, the truck was serviced on my purchase in April 2008 approx 7.5 k next service 27/8/2008 17659, next service 13/10/2009 41189 and the final service 12/11/2010 64554.
The engine failed in March 2011 with 70k piston ring in number 4 cylinder broken with scored bore, damaged head, new engine required. Have taken up situation with dealer Nissan offered to pay for half the engine so my half and labour is £7K plus, have escalated to Black Horse who have had discussions with Main dealer and Nissan, whilst the main dealer is saying the service record is satisfactory Nissan is saying because the service schedule is 12 months or 18k I have not kept to service schedule this has caused the failure, and Nissan will not alter from its initial offer so to fix the truck will cost £6,515.34, I also have just under 5k outstsnding on finance.
Could you give me advice to what options I have, I do not have the finance to repair the truck, it is not cost effective to repair and then sell as the re is not enough value repaired to pay the repair and pay off the finance company.
To me the truck under the sale of goods act is not suitable for purpose but dont know what my next steps can be.
The missed/late oil services are the direct reason for the failure so be grateful that Nissan is looking after you as much as it it.
