Faulty baring - wear and tear or warranty issue?

Recently, the nearside front hub nut on my two year old Hyundai i10 started to work itself loose. I only noticed it when I tracked it down to a non-engine related noise. After jacking the car up I found there was a very substantial wobble with a good 2cm play in the wheel. The RAC were called out and it was a simple repair in tightening the nut and deforming it (this had not been done during manufacture).

My point is that this may have been working loose for some considerable time. I had taken the car back to the dealership over a year before because of suspicious front tyre wear and they failed to find anything. I spoke to them again and they said it would be 'standard' wear and tear. I was quite shocked by the response because any wear on that bearing would be a direct result of a manufacturing defect. Are they within their rights?

No. Presumably you have kept a copy of the RAC call-out. If the bearing starts to moan within the five year warranty you can use the RAC report to insist that it is replaced FoC because the car was originally supplied with a fault.

If the dealer makes you pay, sue for the cost, but be sure to have the car repaired by the dealer who sold it to you. Case law is Clegg v Olle Andersson, House of Lords, 2003.
