I was misled about the mpg and battery range on my BMW hybrid - how should I proceed?

BMW quote up to 148mpg, battery mileage up to 25 miles for my BMW 330e. I can only attain 58 mpg and battery range between 6.8 and 12 miles. I feel I have been misled badly by BMW. I would value your opinion on how to proceed further in resolving this problem with them. I've been been back to BMW to check battery, which they confirm is okay.

No, you have not been misled by BMW. You have been misled by the ridiculous NEDC lab test drive cycle that massively favours plug-in hybrids. It is normal for battery range to deteriorate in use because if the battery is not regularly charged correctly it loses its capacity to hold a full charge. You might have a case about that.
